Welcome to the website (“the Site”) and the application (“the App”) of Ken-Hator Group Ltd. and/or its affiliated companies (“the Company” or “we”). Use of the Site, the App, their contents, and the services offered through them is subject to these terms (“Terms of Use”), the Company’s Privacy Policy available at: https://ken-hator.com/en/privacy/, and additional Company guidelines as detailed on the Site and in the App.

The use of masculine form is for convenience only, and these Terms of Use apply to all genders.

These terms define the relationship between the Company, its representatives, and the Company’s clients and visitors using the Site, including the client portal (as defined below) and/or the App, its content, and services (“the Clients” or “the Users” and “the Services,” respectively). If you do not fully or partially agree to the Terms of Use and/or the Privacy Policy, you may not use the Site, App, or Services.

Client Portal on the Site and App
The Site (through the client portal, “the Portal”) and the App offer services via a dedicated personal area for Company clients, allowing access to view, track, and manage the home-buying process from signing the sale agreement to receiving the key. A client who enters the personal area with login credentials (as defined below) can access information about their purchased apartment, perform actions such as reporting issues, opening service calls, reviewing the sale agreement, viewing apartment plans, scheduling meetings with the Company, selecting suppliers, and more – all in an efficient and convenient manner (“the Purpose”). To provide these services, users will be asked to provide personal information as required for the requested service. This information is necessary for service provision and will be stored and used by the Company in accordance with the Privacy Policy, which is an integral part of the Terms of Use.

Use of the App requires installation on a compatible device and an active internet connection. Access to the Portal and App is subject to login credentials consisting of a username and personal password assigned by the Company (“Login Credentials”). These credentials are personal and must be kept confidential. The Company reserves the right to revoke or suspend access for users who do not comply with the Terms of Use. In accordance with the Terms of Use, the Company grants you a non-exclusive, non-transferable, and non-sublicensable license to access the Portal and App for personal, private use and solely for the stated purpose.

Intellectual Property Rights
All copyrights, design elements, images, segments, content, and all other materials appearing on the Site and App – including design, music, photos, images, illustrations, audio clips, video clips, text, graphics, software, hardware, specifications, data, processes, applications, enhancements, upgrades, computer code, user interface, design languages, and interactive features – are the exclusive property of Ken-Hator and/or the authorized entities.

Prohibited Uses

You agree to use the Site, App, and Services fairly and reasonably, and to avoid actions that may harm the Site, App, Ken-Hator, or the rights of other users. You agree not to:

Copy, modify, distribute, transmit, publicly display, transfer, publish, process, create derivative works from, or sell content from the Site or App without written permission.
Use technological means (e.g., scraping or data mining) to collect information from the Site or App.
Infringe third-party rights, including intellectual property or privacy rights.
Alter the design of content appearing on the Site or App.
Share login credentials with unauthorized individuals.
Take actions that could damage the reputation of Ken-Hator, the Site, App, or other users.

Limitation of Liability

Use of the Site, App, and Services is at the user’s sole responsibility. Ken-Hator is not liable for direct or indirect damages, including physical, emotional, consequential damages, loss of profits, or any other harm resulting from use of the Site, App, or reliance on their content. Some content and services may be owned by third parties and are not under Ken-Hator’s control. We recommend reviewing those third parties’ terms of use. In case of any damage, the user agrees to compensate Ken-Hator and any of its representatives. In any case, subject to legal ruling, Ken-Hator’s liability shall not exceed 100 ILS.
